Preamble
The following general terms and conditions of sale govern all transactions established on the FlyingTravel.ma website. Any order placed on this site implies the customer's unconditional and irrevocable acceptance of these conditions.
Object
This contract is a distance contract intended to define the rights and obligations of the parties in the context of the sale of products by the company FlyingTravel on the Internet, through the Maroc Telecommerce platform. FlyingTravel and FlyingTravel.ma are a service and a registered trademark of FlyingTravel S.A.R.L. Maroc Telecommerce is a transaction management service and a registered trademark of Maroc Telecommerce S.A.
Definitions
Throughout the contract, each of the expressions mentioned below will be understood according to its definition, namely:
"Distance Contract": any contract concerning goods or services between the Company FlyingTravel and a Consumer within the framework of a distance selling or service provision system organized by the Company FlyingTravel which, for this contract, exclusively uses the Internet network until the conclusion of the contract, including the conclusion of the contract itself.
"Consumer": any natural person who, in this contract, acts for purposes which are outside the scope of their professional activity.
"Order Form": a document that indicates the characteristics of the Products ordered by the Consumer and which must be signed by them with a "double click" to be binding.
"Order": the act by which the Consumer commits to purchasing Products and the Company FlyingTravel commits to delivering them.
Article 1. GENERAL INFORMATION:
The FlyingTravel.ma website is the property of the travel agency FlyingTravel, located at Av. Cheikh Rabhi (Route de Targa), Centre d'affaire Victor Hugo, Bureau N3 - Guéliz. Marrakech. Holder of travel agent license n°03D/12, RC: 39619, ICE: 06523977, Capital 220,000 Dhs. By using the FlyingTravel.ma website, the customer acknowledges having read and accepted its terms of use. The customer also vouches for the accuracy of the information provided.
Article 2. PAYMENT METHODS:
2.1 Payment Method:
To pay for your order, you choose the payment method from those offered by FlyingTravel.ma on the payment page.
In the case of online payment, the transaction is submitted for debiting your account on the day following the delivery confirmation date.
Your multi-channel payments are secured by the Centre Monétique Interbancaire (CMI), which offers a fully secure payment service.
The Consumer guarantees the Company FlyingTravel that they have the necessary authorizations to use the payment method chosen by them when validating the Order Form.
In case of payment by credit card, the provisions relating to the fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the card issuer, and between the Company FlyingTravel and its banking establishment, apply.
2.2 Proof of transactions paid by credit card:
The data recorded by the CMI on the multi-channel payment platform on behalf of FlyingTravel constitutes proof of all commercial transactions between you and the company FlyingTravel.
2.3 Other payment methods: For all reservations on the FlyingTravel.ma site, only the following payment methods are accepted: 1- Credit/debit cards. 2- Cash. 3- Bank check. 4- Bank deposit/transfer.
Article 3. RESERVATION AND CONFIRMATION:
3.1. Reservation: Before any reservation, the customer must log into their account: login and password. To make your reservation, you must add the product of your choice to your cart. Your reservation will be considered once you have completed the steps in your cart: choose the payment method, validate the final quote, and confirm the reservation. Payment will be made as soon as the reservation is made.
3.2. Confirmation: The final confirmation of your cart can only be made after full payment of your order and confirmation of the availability of the reserved product.
3.3. Flight section: The customer is required to respect the conditions relating to their booking. These conditions are determined by the airline (baggage allowance, check-in time, etc.). The FlyingTravel agency is not responsible for flight delays or cancellations, or for airport formalities.
3.4. Hotel section: The customer is required to respect the conditions previously defined by the hotelier, particularly in terms of check-in and check-out. They agree to present their voucher upon arrival at the hotel to check in and to respect the check-out time, according to the hotel.
3.5. Travel documents: The customer is required to check all their travel documents:
Flight: origin/destination, airports, dates/times, airline/flight number, passenger information (passport, name, etc.), baggage allowance.
Hotel: names of occupants, age of children, room category, dates of stay, meal plan (breakfast, lunch, half board, all-inclusive, all-inclusive with alcohol).
Article 4. PRICING
The prices displayed are subject to availability at the time of payment. It is clearly mentioned in the product description what is included in the price and what is not. For packages, the hotel name is displayed for information purposes followed by "or similar." If our room allotment in that hotel is reached, a hotel of a similar category will be systematically offered.
Article 5. MODIFICATION, CANCELLATION, AND REFUND
5.1. Modification and cancellation by the customer: All reservations are final and cannot be canceled. If modification is possible, it will incur fees.
5.2. Modification and cancellation by FlyingTravel: In the event of a trip cancellation by FlyingTravel, the agency will offer a refund of the costs advanced by the customer or similar travel offers.
5.3. Refund No refund request will be accepted in the event of changes made to the package by its suppliers (hoteliers and airlines) beyond FlyingTravel's control.
5.4. Disputes and claims As FlyingTravel is an intermediary between customers and the various service providers (airlines, hoteliers, and other providers), it can only assume responsibility for claims falling under its direct responsibility and not the responsibility of its partners.
Article 6. ADMINISTRATIVE FORMALITIES
The traveler is required to check:
The validity of their passport.
The entry requirements for the destination country.
Other necessary travel documents (visa, authorization to leave the territory, parental authorization, etc.). The agency is not responsible in case of refusal of boarding or entry by the authorities. In accordance with the regulations of the Office des Changes (Foreign Exchange Office), a deduction will be made from your foreign currency allowance to pay for services abroad.
Article 7. JURISDICTION
In the event of a dispute, the court of Marrakech shall have sole jurisdiction.
